Brent Stahl will present the paper entitled Mineral Issues’ Impact on Solar Energy Development in Texas and Other States co-authored by Brent Stahl, Alison Gardner and David Sewell on a panel discussion Mineral Issues’ Impact on Solar Energy Development in Texas and Other States at the Wind, Solar and Renewables Institute, The University of Texas at Austin School of Law.  The panel will examine title insurance, the accommodation doctrine, non-interference agreements, waiver of surface rights and other ways to mitigate the risk that mineral estate rights could adversely affect the operations of a solar energy project site. Lisa Chavarria will moderate a panel discussion entitled, Current Legal Issues Related to Wind Lease and Easement Agreements at the Wind, Solar and Renewables Institute, The University of Texas at Austin School of Law.The panelist will look at how maturation of the wind industry has led to the emergence of new issues related to wind lease and easement agreements. The panel discusses wind lease drafting and negotiation challenges with a focus on essential lease provisions including those needed for a financeable lease. This session also takes a look at the growing conflicts between oil and gas operators and wind developers, the types and validity of wind severance rights, and zoning ordinance requirements in leases. The 2011 Texas Journal of Oil, Gas and Energy Law Journal’s Law Symposium

As the wind industry matures, practitioners face new legal issues related to wind project development and operation and are expanding their practices into solar and geothermal.  At the center of these renewable energy transactions are surface and subsurface rights and the instruments necessary to secure those rights. This session focuses on issues related to surface and subsurface leases including due diligence considerations, the severance of property rights, the accommodation of oil and gas development, and siting issues.
