Gilbert Bernal, Jr.
Gilbert Bernal is a tax attorney and partner in the law firm of Stahl, Bernal & Davies, LLP, where he practices in the firm’s Texas Tax Litigation Section. He represents a wide cross-section of clients, corporations, partnerships, and individuals, from various states in connection with their administrative and judicial challenges to Texas tax audits by the Comptroller of Public Accounts. He also represents clients in tax refund claims filed with the Comptroller, including Texas franchise tax and Texas sales tax refund claims. His practice includes state tax planning and administrative and judicial litigation against other Texas taxing agencies that assess taxes and fees.
Mr. Bernal received his J.D. from the University of Texas at Austin, during which time he served as a law clerk in the Taxation Section of the Attorney General’s office. He graduated from U.T. at Austin with High Honors with a B.A. in Government. He is a member of the American Bar Association, the State Bar of Texas, the Travis County Bar Association, and the Tax and Litigation Sections of those organizations.
Representative Transactions
- Represented the Comptroller and the Texas Attorney General in numerous tax trials, appellate arguments, including four arguments in the Texas Supreme Court, from 1975-1983, serving the last two years as Chief of the Attorney General’s Taxation Division.
- Represented major out-of-state clients and local businesses in franchise tax and sales tax litigation where the courts awarded attorney’s fees to the taxpayers against the State.
- Represents major cigarette and tobacco products distributors in tobacco and cigarette tax litigation against the Comptroller.
- Represents various Fortune 500 oil and gas companies, automakers, insurance companies, telecommunications companies, and defense contractors in franchise tax and sales tax litigation against the State of Texas.
